BBMRI.nl, Health-RI and Coreon wrote a letter to the members of the European Data Protection Board warning that the requirement to comply fully with the GDPR would significantly hinder research collaborations
The territorial scope of General Data Protection Regulation (GDPR) is determined by Article 3 of the Regulation. These guidelines were adopted by the European Data Protection Board, that sent out an invitation to comment on these Guidelines. In response, BBMRI.nl, Health-RI and Coreon jointly expressed their worries about the implications of certain aspects of the proposed Guidelines. On behalf of Dutch health-researchers and research initiatives, the organizations wrote a letter to the members of the European Data Protection Board. In this letter, they warn that the requirement to comply fully with the GDPR would significantly hinder research collaborations with partners outside the EU, or even completely stop international collaboration for EU based institutes. The authors advise the EDPD that the GDPR should not apply to research institutes outside the EU, solely because they are collaborating in an EU funded project. The EDPD is considering the comments. The guidelines have not been determined yet.
